DPS Skis Limited Warranty
1. Coverage
1.1 Lifetime Limited Warranty
DPS USA Made Skis purchased new on or after July 1, 2022 from DPS Skis or an authorized DPS Skis dealer are warranted against defects in materials and workmanship for the functional lifetime of the product, subject to the terms below.
"DPS USA Made Skis" means full carbon skis manufactured in the United States, currently the Kaizen, Wailer, Pagoda Tour CFL, Pagoda Tour, Pagoda, Pagoda Piste, Lotus, Pisteworks, and Powderworks models. DPS may revise this list; the list in effect on the date of purchase governs.
"Functional lifetime" means the period during which the product remains serviceable under normal recreational use. It does not mean the lifetime of the purchaser and does not constitute a perpetual replacement guarantee.
1.2 Two-Year Limited Warranty
The following are warranted against defects in materials and workmanship for two (2) years from the date of purchase: poles, apparel, luggage and bags, climbing skins, DPS-branded bindings, and Koala and Foundation series skis.
1.3 Original Purchaser Only
This warranty extends solely to the original purchaser and is not transferable. Proof of original purchase is required for all claims.
2. Eligibility Requirements
A claim is eligible only if all of the following are met:
(a) The product was purchased new from DPS Skis or an authorized DPS Skis dealer. Products purchased secondhand, from unauthorized resellers, from demo or rental fleets, or through private sale are excluded.
(b) The claimant is the original purchaser.
(c) Valid proof of purchase is provided. Acceptable proof includes a dated retail receipt, order confirmation, or invoice showing the seller, date, and product purchased. Handwritten receipts are not accepted. For purchases made directly from DPS, DPS may verify the order internally.
(d) The claim concerns a defect in materials or workmanship, not damage as described in Section 3.
(e) The product has not been altered as described in Section 3.9.
3. Exclusions
This warranty does not cover:
3.1 Impact damage. Damage resulting from contact with rocks, stumps, ice, terrain features, other skis, or any object encountered during use, including core shots, gouges, edge cracks, and base or topsheet punctures.
3.2 Modifications. Any damage arising from custom modification of the product, including but not limited to detuning beyond manufacturer specification, altering the profile, or any structural alteration.
3.3 Transport and storage. Damage caused by chairlifts, ski racks, vehicle transport, air travel, improper storage, prolonged exposure to heat or moisture, or oxidation of hardware resulting from storage conditions.
3.4 Tuning and maintenance. Damage caused by base grinding, edge tuning, waxing technique, hot boxing, or any service performed by the purchaser or a third party, including damage arising from over-grinding, base burn, or excessive edge material removal.
3.5 Cosmetic wear. Topsheet chipping, scratching, fading, graphic wear, base discoloration, and other cosmetic conditions that do not impair the functional performance of the product.
3.6 Mounting and service defects. Damage resulting from binding installation, remounting, or any service performed by a party other than DPS, including damage caused by improper hole placement, insufficient hole depth, stripped inserts, or failure to use appropriate hardware.
3.7 Threaded metal binding inserts. DPS neither sells nor installs threaded metal binding inserts. This warranty does not cover any matter related to the installation of such inserts or the subsequent durability of the mount. Other aspects of the ski — edge, sidewall, topsheet, and base — remain covered subject to these terms.
3.8 Normal wear. Deterioration consistent with the expected service life of the product under normal use, including base wear, edge wear, and reduction in camber over time.
3.9 Unauthorized repair. Any repair or alteration that permanently removes or modifies part of the product. Routine maintenance — tuning, base grinding, and binding mounts performed to specification — does not void coverage. Where emergency field repair is unavoidable, coverage may be preserved if the purchaser photographs the condition before altering the product, avoids removing material where possible, retains any detached components, and submits a claim promptly with full disclosure of the repair.
3.10 Vandalism, theft, and loss.
3.11 Continued use after discovery. Any damage that results from, or is aggravated by, continued use of the product after a defect has been discovered.
3.12 Commercial and rental use. Products used in rental, demo, instructional, or other commercial applications.
4. Claims
4.1 Submission
Claims must be submitted through the DPS warranty claim form at [URL] and must include:
- Proof of purchase meeting the requirements of Section 2(c)
- The product serial number
- Photographs of the complete product and close-range photographs of the condition claimed
- A description of the condition, when it was first observed, and the circumstances of use
Incomplete claims will not be evaluated until the required information is received.
4.2 Evaluation
DPS will review each claim and respond in writing. DPS may require the product to be returned for physical inspection at the claimant's expense; where a defect is confirmed, DPS will reimburse reasonable inbound shipping. Determination of whether a condition constitutes a covered defect is made at the sole discretion of DPS.
4.3 Notice
Claims must be submitted promptly upon discovery of the condition. Delay that prevents DPS from evaluating the condition, or that permits further damage, may result in denial.
5. Remedies
5.1 Available Remedies
Where a claim is approved, DPS will, at its sole election, repair the product or replace it. DPS will attempt repair before replacement where repair is feasible.
Refunds are not available as a warranty remedy.
5.2 Replacement Terms
Where replacement is elected, DPS will provide the identical model, length, and construction where available.
Where an identical replacement is unavailable:
(a) If the product was current in the DPS line on the date of purchase, DPS will provide the equivalent or successor model subject to availability.
(b) If the product was discontinued on the date of purchase, DPS will issue a credit toward a replacement. Such credit will not exceed the original purchase price and may not cover the full retail price of the selected replacement.
(c) Construction upgrades, where available, may be offered at additional cost.
5.3 Single-Ski Replacement
Where a defect affects one ski of a pair, DPS may replace that ski alone, subject to inventory availability.
5.4 Advance Replacement
At the sole discretion of DPS and with prior written authorization, DPS may ship replacement product in advance of return. The claimant will be charged the full price of the replacement and will have ninety (90) days from shipment to return the original product, upon receipt of which the charge will be refunded. Failure to return within the stated period forfeits the refund.
5.5 Expiration of Approved Claims
An approved claim expires ninety (90) days after the date of approval. Failure to accept and complete the offered remedy within that period constitutes forfeiture. Extensions may be granted at the sole discretion of DPS upon written request made prior to expiration.
5.6 Warranty Period of Replacement Product
Replacement product assumes the remaining warranty term of the original product. Replacement does not extend, renew, or restart any warranty period.
6. Exclusions of Other Costs
This warranty does not cover, and DPS is not responsible for:
- Binding remount, tuning, or service costs associated with warranty repair or replacement
- Rental or replacement equipment costs during claim processing
- Lift tickets, season passes, travel, lodging, or any other incidental expense
- Loss of use or loss of enjoyment
7. Limitations and Disclaimers
7.1 To the maximum extent permitted by applicable law, the express warranty stated herein is in lieu of all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Where implied warranties cannot be disclaimed under applicable law, they are limited in duration to the period of the express warranty stated herein.
7.2 To the maximum extent permitted by applicable law, DPS shall not be liable for incidental, consequential, special, punitive, or indirect damages arising from the use of, or the inability to use, any DPS product.
7.3 Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, or limitations on the duration of implied warranties, so the above limitations may not apply. This warranty gives you specific legal rights, and you may also have other rights which vary by jurisdiction.
7.4 Skiing and ski touring involve inherent risk of injury or death. This warranty addresses product defects only and makes no representation regarding the safety of the activity or the suitability of any product for any particular user, condition, or terrain.
8. General
8.1 Amendment. DPS reserves the right to modify this warranty at any time. The version in effect on the date of purchase governs that purchase.
8.2 Authorized dealers. A current list of authorized DPS dealers is available. Purchases from sellers not appearing on that list are not covered.
8.3 International purchases. Warranty administration for products purchased outside the United States may be handled by the applicable regional distributor. Contact DPS for direction.
